Abstract:

This talk explores the ‘regulation’ of international commercial arbitrators, based on the book The Regulation of International Commercial Arbitration: Arbitrators’ Duties and the Emerging Arbitral Market. This academic work adopts an interdisciplinary approach, appealing to those interested in international commercial arbitration and professional regulation. The book’s core argument is that an effective regulatory framework governs the conduct of international commercial arbitrators. It examines how and why the regulation of these arbitrators differs from other professions, such as accounting, law, and medicine. The work further dissects the various elements that shape and enforce professional norms in this field. Finally, the talk will address the strengths and limitations of the regulatory system, including issues related to arbitrator independence and impartiality, procedural efficiency, fairness in appointments, and the consideration of public interest by commercial arbitrators.
