Professor Fan Kun specialises in international arbitration, mediation, and socio-legal studies. She is Associate Professor of Law at UNSW Law and Justice and a member of the China International Business and Economic Law Centre.

Abstract:
This talk embarks on an interdisciplinary journey to unravel the cultural and philosophical tapestry underpinning arbitration practices across diverse human societies. By applying a three-dimensional theory of human faculties (mind, heart, soul) and societies (legal, moral, religious), it offers a fresh lens through which to understand the influence of various traditions on arbitration. The talk highlights the need for a nuanced understanding of arbitration, advocating for cultural sensitivity and adaptability in international arbitration practices and education. It invites scholars and practitioners alike to re-evaluate not just how arbitration is practiced, but more profoundly, why it is shaped in diverse and intricate ways, searching for deep-seated social and philosophical reasons underlying its diverse manifestations.

講座摘要：

在西力衝擊下，二十世紀初中國發生各種翻天覆地的巨變，包括憲法在內的法律體系，自無例外。中國法學界一方面繼受西方權利為本的憲法主義，另一方面又對當時席捲西方的社會達爾文思潮趨之若鶩。權利為本的憲法主義和弱肉強食的「天演論」，不啻兩套南轅北轍的價值系統，兩者卻在中國匯流，並塑造了南京政府中華民國憲法草案的基調。本書從比較法律思想史的進路，聚焦二十世紀前期日本、美國、中國三位憲法巨擘|加藤弘之、霍姆斯及吳經熊的憲法權利觀，探索他們如何處理這兩種思想之間的張力，以達到自己安身立命的歸宿。透過《天演論》對中國繼受西方法律的影響、加藤弘之「進化論」為明治憲法的背書、霍姆斯對天賦人權的徹底否定，到吳經熊歸宗霍姆斯並在中國推廣「有法無天」的天演格局憲法權利觀，作者展示了「叢林憲法觀」如何在天、人、法三者之間互相激盪，並在二戰前的日本、美國和中國佔據上風。

上世紀九十年代開始，來自緬甸、越南、柬埔寨等東南亞國家的外來新娘經人介紹或被誘騙至中國內地，淪為了生育工具。影片中的女主角Larry出生在緬甸北部，小時候上山砍柴摔斷了腿，沒錢醫治，落下殘疾。在十五六歲的時候，跟隨姨媽到了中國北方，嫁給了一個比她大很多的男人，和這個男人過了十幾年，生了兩個孩子。這期間拉瑞曾離家出走，和一個年輕男性結婚生了一個女孩。

炎炎夏日到了，拉瑞回到緬北老家。

影片圍繞拉瑞一家展開，攝影機時刻在關注拉瑞和她的丈夫、孩子的一舉一動，試圖找尋這個“外來女性”拋棄孩子，執意離家的真正原因。影片似乎並未直接給出答案，這個生活窘迫，窮困潦倒，遠嫁他鄉的女性背負著家人的賺錢期望，面對丈夫的嫌棄以及孩子的不解，她所選擇建立的跨境婚姻從一開始就是不對等的。Larry之所以選擇離開，也許是要去尋找一個和自己年齡差不多大的、對自己好的、能安安穩穩的過上一輩子男人。用她自己的話說就是找一個男人，“不用再嫁一家一家的，他對俺好，俺會對他好一輩子的，永遠不會再離開他”。尋找人生的幸福和美好，這或許就是拉瑞離家出走的真正原因吧。
